March 21 (Reuters) - A Chevron attorney said in court on Wednesday that the company supports scientific conclusions that humans are causing climate change, a response to a lawsuit that accuses five major energy producers of misleading the public for years about their role in global warming. At a hearing in San Francisco federal court, Chevron attorney Theodore Boutrous also said that the scientific consensus about greenhouse gas emissions did not fully form until the past decade. The cities of San Francisco and Oakland, California sued Chevron Corp, Exxon Mobil Corp, ConocoPhillips , Royal Dutch Shell PLC, and BP PLC last year, seeking an abatement fund to help the cities address flooding they say is a result of climate change.”

Shocked? You shouldn’t be. Pay attention to exactly what the Chevron attorney said: “…that humans are causing climate change…”. Not Chevron. Not any petroleum company. But “humans”. And exactly what humans are DIRECTLY producing the majority of GHG? Those humans burning fossil fuels. And not just motor fuel and NG but also coal. Coal, the largest single source of GHG. Coal, little of which is sold by the companies mentioned in the San Francisco lawsuit. Coal which is burned by utility companies, such those in almost every country in the world, or by individuals.

There are a few here that get enraged when I make this obvious point. Yet have not offered a single response showing how I’m not correct. A perfect analogy is the automobile industry. Many hundreds of thousands are killed by vehicles every year. And as long at those were caused by mechanical problems that existed as the vehicle left the plant the vast majority of those accidents were caused by a human. Vehicles, most of which are powered by fossil fuels, also produce huge amounts of GHG. Should auto makers also be held responsible for climate change? After all more GHG is DIRECTLY produced by those vehicles then is DIRECTLY produced by all the oil/NG combined.

Also understand that every govt on the planet has partnered with every oil/NG producers. Not only approving the drilling of every oil/NG well but effectively paid for many of those efforts. Yes: paid the companies. Consider just the offshore USA. The govt paid the companies to produce every one of those billions of bbls of oil and every Btu of those trillions of feet of NG. The US federal govt paid those companies about 84% of the value of that fossil fuels to drill and produce them. The govt retained about 16% of the value for itself. Oh, the govt also collected $billions in taxes from those companies. And since the govt is the citizens those folks essentially paid those companies to produce that oil/NG.

Speaking of which, consider the city of San Francisco that filed that lawsuit. In 2013 CA collected $1.2 BILLION in various fees from oil/NG production. That does not include revenue from taxes paid by oil companies and their employees. Given CA long history of oil/NG production obviously the state has collected many tens of $BILLIONS from the production of oil/NG. A side note: Chevron has been one of the largest oil/NG producers in CA. And naturally San Francisco got its share of that benefit. So since not only has CA allowed oil/NG production but has greatly benefited financially shouldn’t the state (or its citizens) also be sued for participation in the production of oil/NG? In fact shouldn’t all US citizens?

Don’t think about think about these questions emotionally. Think strictly as a lawyer standing in front of a judge. A judgement that may likely end up in front of the SCOTUS.

Exxon's $200 million denial campaign should be subject to criminal prosecution. Who burns the oil is irrelevant. By sabotaging public awareness of the crisis, Exxon and pals stopped action to address CO2 production from various economic activities. The claim about the last decade is a total crock since that would imply the scientific consensus appeared after 2008. It was already there during the early 1990s. The real issue is that decades have been lost thanks to Exxon and pals, which could have been spent transitioning the economy to low CO2 production as per the Hirsch report.
